The Three Main Benefits to Workers’ Compensation Victims

THREE MAIN BENEFITS UNDER THE ILLINOIS WORKERS COMPENSATION ACT

 There are three main benefits for injured workers in Illinois under the Illinois Workers’ Compensation Act. They are:

  1. Payment of all your medical bills.
  2. Payment of TTD benefits (Temporary          Total Disability benefits).
  3. Payment of a PPD settlement                       (Permanent Partial Disability settlement at the end of the case).

The first benefit of payment of all your medical bills requires that the workers’ compensation insurance company pay all of your medical bills resulting from the work injury pursuant to the medical fee schedule. Under this benefit there is also a two doctor rule. This rule states that you can go to two separate doctors and any other medical professional that those doctors may refer you to. The rule does not mean that you are only able to see two doctors. The two doctor rule allows you to get a second opinion or go to a new doctor if you do not believe your first doctor is helping you get better. You should always get a referral from your first doctor to every other medical professional so not to avoid the two doctor rule. If your orthopedic doctor recommends that you see a neurologist, make you get a referral for a neurologist from the treating physician rather than finding a neurologist all on your own so not to violate the two doctor rule.

The second benefit is TTD benefits which stands for temporary total disability. This benefit is 67% of your average weekly wage. This weekly benefit is paid to you when you are off work recovering from your injury. This benefit will continue until you are able to return to work. In some cases the Respondent will cut off your TTD benefits when their doctor says that you can go back to work even when your doctor keeps you off work. If this occurs, you are in need of experienced workers’ compensation attorney in your corner. The third benefit is a PPD settlement. This is how much money you will get a result of your work injury. The amount of money you receive for your work injury depends on your average weekly wage. For the exact same injury a worker earning $20.00 per hour will get twice as much as a worker earning $10.00 per hour. On its face that does not seem fair, when both workers’ suffered the same injury, but that is the law and the law does not allow for pain and suffering in a permanent partial disability settlement.
